By accessing, browsing or placing an order through this website, you agree to be bound by these Terms & Conditions, together with our Privacy Policy and Shipping & Returns policy, each of which is incorporated by reference. If you do not accept these terms in full you must not use this website. We may revise these terms at any time by updating this page; the version in force at the moment your order is accepted governs that order, and continued use of the website after any change constitutes acceptance of the revised terms. Content on this website, including text, imagery, product renders, layouts, source code, trade marks and the Fishelper name and logo, is owned by us or our licensors and is protected by intellectual-property law; any use, reproduction, framing, scraping, republication or automated collection of the website's content without our prior written consent is strictly prohibited.
Orders, prices and acceptance
The display of a product on this website constitutes an invitation to treat and not a binding offer. A contract of sale is formed only when we send you an order-confirmation email expressly accepting your order; the automatic acknowledgement generated on checkout is not an acceptance. We reserve the right, without giving reasons, to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, incorrect pricing, stock unavailability, delivery to jurisdictions we do not serve, or breach of these terms. Prices, product specifications, availability, images and promotional discounts may change without notice; obvious typographical errors in price or description do not bind us and any order placed at such an incorrect price may be cancelled and refunded. Payment is due in full at checkout and title in the goods passes to the buyer only upon receipt of cleared funds.
Warranties and liability
The products are supplied with the statutory conformity warranty required by Directive (EU) 2019/771 for consumers resident in the European Union; no additional commercial warranty is offered. Beyond the mandatory statutory warranty, and to the fullest extent permitted by applicable law, all other warranties, conditions and representations, whether express or implied by statute, common law, custom or otherwise, are hereby excluded. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under mandatory law. Subject to the foregoing, our aggregate liability arising out of or in connection with any order, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total price paid by the buyer for the specific product giving rise to the claim, and we shall not be liable in any circumstances for loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of data, or for any indirect, incidental, special or consequential loss howsoever arising. We accept no liability for damage, injury or loss arising from misuse of the product, use outside its stated specifications, unauthorised repair or modification, use with incompatible accessories, failure to follow the user manual and safety instructions, or use by minors.
Governing law and disputes
These terms and any non-contractual obligations arising out of or in connection with them are governed by the law of the country in which Fishelper is legally established, without prejudice to any mandatory consumer-protection rules of the country in which the buyer is habitually resident. Any dispute shall first be addressed through good-faith negotiation between the parties; failing resolution, the courts of the seller's registered seat shall have exclusive jurisdiction, save that consumers retain the right to bring proceedings in the courts of their habitual residence. Consumers in the EU may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for out-of-court resolution. If any provision of these terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
